Looking for a Naples Divorce Attorney?

What to know when looking for a Naples divorce attorney

Many happy marriages start in Naples Fl. , then end in divorce which then requires an attorney. Divorce is always a traumatic event, even Florida no fault separations. In a simple dissolution of marriage, where there are no assets or children, you may not need a Naples divorce attorney. However, if you and your spouse have joint bank accounts, or own a home together, you will need legal counsel in order to divide your assets equitably. "Pro se" (representing yourself in court) is not recommended at this stressful juncture of your life.

The sooner that you realize that you will need a lawyer to cope with your divorce, the better chance you will have at a fair distribution of property. Division pf property is only one, and certainly not the most important, legal issue that needs to be resolved. If you have children together, the stakes are raised considerably. As any parent will tell you, finances pale in comparison to child custody concerns. Who retains custody, and the associated factors such as visitation, child support and visitation can get quite contentious. Even if you think you and you soon to be ex have sorted out all the details, anyone can change their mind at the last minute. If you have not, at the very least, consulted with a Naples divorce attorney, you may find yourself caught off guard when your spouse walks in with their lawyer and you are standing there in court legally defenseless.

There are certain circumstances where dual representation (meaning you both have the same lawyer) are possible, but generally this is frowned upon. Sometimes this can lead to problems down the road where on of the parties feels that the joint attorney favored the other party. This can lead to lawsuits and judgement modification litigation. In almost all cases, most legal experts advise against dual representation. The chance of conflict later on is just too high.

As the state of Florida requires court ordered mediation before any divorce trial can begin, this is another very important reason to have a qualified and experienced Naples divorce attorney on your side. Financial  summaries are required before asset mediation can begin. Your lawyer will be experienced in presenting your side of the argument in the best possible light, which can help you save more money than your legal representation costs.

  5. Being a child custody attorney would not be easy. There are so many things that go into a court case involving children, and it takes a good lawyer to know what to do. I'm grateful that we have lawyers that help people out in these situations. They help society run a bit smoother and help people have better lives.
